Terms of Service

1. The service

Markly is an AI-assisted worksheet marking tool that helps teachers transcribe, assess, and provide feedback on student work. The service is currently in private beta.

2. Your account

You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials. Accounts are intended for use by teachers and authorised educators only.

3. Acceptable use

You agree to use Markly only for legitimate educational purposes. You must not:

  • Upload content that is inappropriate, offensive, or unrelated to student work.
  • Attempt to access other users' data or accounts.
  • Use the service in any way that violates applicable laws or regulations.
  • Resell, redistribute, or commercially exploit the service without permission.

4. AI-generated content

Feedback, scores, and reports generated by Markly are AI-assisted suggestions, not definitive professional assessments. All AI output should be reviewed and approved by a qualified teacher before being shared with students or used for formal assessment purposes. We do not guarantee the accuracy of AI-generated content.

5. Your data and intellectual property

You retain full ownership of all content you upload to Markly, including student worksheets, feedback edits, and custom rubrics. We do not claim any intellectual property rights over your content. We use your data solely to provide and improve the service, as described in our Privacy Policy.

6. Data protection

You are responsible for ensuring you have the appropriate consent or legal basis to process student work through our service, in accordance with UK data protection legislation (UK GDPR and the Data Protection Act 2018). Where you upload student work, you act as the data controller and Markly acts as a data processor.

7. Service availability

Markly is provided on an “as is” and “as available” basis. As a beta service, we do not guarantee uninterrupted availability or that the service will be free from errors. We may modify, suspend, or discontinue features at any time.

8. Limitation of liability

To the fullest extent permitted by law, Markly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

9. Termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or a notice within the application. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
